Porsche driver Richard Pusey is facing more than a dozen charges over the fatal crash that left four police officers dead in Melbourne.
He was also accused of filming and taunting a dying policewoman, but according to his lawyers, he was speaking to himself.
“Now you’ve f**cked my f**king car,” he allegedly said at the time to Senior Constable Lynette Taylor as she laid dying on the road.
“The way this charge is put against Mr Pusey is the fact there was filming of the accident scene and he said words basically to himself,” Mr Dann said.
Mr Dann said his client wanted to resolve the matter quickly but a particular sticking point was the charge of “outraging public decency”.
“We haven’t located any reported case in hundreds of years of legal history in this country,” Mr Dann said.
The lawyer argued the charge “can’t be made out legally, can’t be made out factually”.
“If this charge can be resolved, there’s a very real prospect the whole matter can be resolved,” Mr Dann said.
He hoped “most” of the charges would be dropped.
Pusey appeared via video link in court and is facing multiple charges, including driving at a dangerous speed, reckless conduct endangering life, destruction of evidence, failing to remain at the scene after a drug test and failing to render assistance.
