Don’t give mum chocolates for Mother’s Day. Take on more housework, share the mental load and advocate for equality instead

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/leah-ruppanner-106371">Leah Ruppanner</a>, <a href="https://theconversation.com/institutions/the-university-of-melbourne-722">The University of Melbourne</a></em></p> <p>With Mother’s Day right around the corner, many grateful and loving families are thinking about what to give mum to show their appreciation.</p> <p>Should you give her chocolate? Nope. Fancy soaps? Nope. Fuzzy slippers, pyjamas, scented candles? No, no and no.</p> <p>On this Mother’s Day, keep your cash and give your wonderful mother gifts that will actually have a long-term impact on her health and well-being.</p> <h2>1. Do a chore that mum hates and hold onto it … forever</h2> <p>Research <a href="https://www.tandfonline.com/doi/full/10.1080/13545701.2020.1831039">shows</a> men have increased the amount of time spent on housework and childcare and that mothers, over time, are doing less (hooray!).</p> <p>But, women <a href="https://onlinelibrary.wiley.com/doi/abs/10.1111/j.1741-3737.2008.00479.x">still do more housework</a> than men, especially when <a href="https://onlinelibrary.wiley.com/doi/full/10.1111/gwao.12497?fbclid=IwAR2dp04p2sFqbDqdehXmXgDSfTYwX3GRzP7ScMJhSOrMePTGQVErR2TTX88">kids are in the home</a>.</p> <p>Further, <a href="https://journals.sagepub.com/doi/abs/10.1177/0891243205285212">men tend to pick up the more desirable tasks</a>, like <a href="https://www.jstor.org/stable/3598304">cooking and playing with the kids</a>, leaving mothers to do the less pleasurable chores (think cleaning toilets and clearing out fridges).</p> <p>The chore divide in same-sex relationships is generally found to be more equal, but some critique suggests equality may suffer <a href="https://www.nytimes.com/2018/05/16/upshot/same-sex-couples-divide-chores-much-more-evenly-until-they-become-parents.html">once kids are involved</a>.</p> <p>This year give your mum (or mums) the gift of equal housework and childcare sharing – start by taking the most-hated tasks and then hold onto them… forever.</p> <p><a href="https://onlinelibrary.wiley.com/doi/full/10.1111/gwao.12727">Research</a> shows housework inequality is bad for women’s mental health. Undervaluing women’s housework and unequal sharing of the chores deteriorates <a href="https://link.springer.com/article/10.1007/s11199-022-01282-5">relationship quality</a>, and <a href="https://journals.sagepub.com/doi/full/10.1177/0038038516674664">leads to divorce</a>.</p> <p>Housework and childcare take up valuable time to keep the family happy, harmonious and thriving, often at the expense of mum’s health and well-being.</p> <p>So, skip the chocolates and show mum love by doing the worst, most drudgerous and constant household chores (hello, cleaning mouldy showers!) and keep doing these… forever.</p> <h2>2. Initiate a mental unload</h2> <p>The <a href="https://www.abc.net.au/news/health/2017-09-14/the-mental-load-and-what-to-do-about-it/8942032">mental load</a> is all of the planning, organising and management work necessary to keep the family running.</p> <p>The mental load is often perceived as list making or allocating tasks to family members.</p> <p>But, it’s so much more – it is the <a href="https://theconversation.com/planning-stress-and-worry-put-the-mental-load-on-mothers-will-2022-be-the-year-they-share-the-burden-172599">emotional work</a> that goes with this thinking work.</p> <p>The mental load is the worry work that never ends and can be done <a href="https://www.tandfonline.com/doi/abs/10.1080/13668803.2021.2002813">anywhere, anytime and with anyone</a> (in, for example, said mouldy shower).</p> <p>Because the mental load is performed inside our heads, it is invisible. That means we don’t know when we or others are performing this labour unless we really tune in.</p> <p>In fact, it is often when we tune in through quiet time, relaxation or meditation that the mental load rears its ugly head. Suddenly you remind yourself to buy oranges for the weekend soccer game, organise a family movie night and don’t forget to check in on nanna.</p> <p>Women in heterosexual relationships are <a href="https://journals.sagepub.com/doi/abs/10.1177/0003122419859007">shown to do more</a> of the mental load with serious consequences for their mental health. But we don’t have a comprehensive measurement of how much women do it nor how it is allocated in same-sex couples.</p> <p>So, on this mothers’ day spend some time talking about, cataloguing, and equalising the family’s mental load.</p> <p>This isn’t just making a list about what has to be done but also understanding <a href="https://www.abc.net.au/news/health/2017-09-14/the-mental-load-and-what-to-do-about-it/8942032">how the mental load</a> connects to the emotional health of the family, and the person carrying this <a href="https://www.newamerica.org/better-life-lab/blog/making-the-mental-load-visible/">invisible labour, worry and stress</a>.</p> <h2>3. Speak up for your mum and all caregivers</h2> <p>Families alone cannot bear the brunt of the caregiving necessary to keep us thriving.</p> <p>Governments, workplaces and local communities also play a critical role. For this mothers’ day, pick an issue impacting mothers (for example, equal pay, affordable childcare or paid family leave) and do one thing to help move the needle.</p> <p>Write a letter to your boss, your local MP, or donate money to an advocacy organisation advancing gender equality.</p> <p>Or, role model these behaviours yourself – normalise caregiving as a critical piece of being an effective worker, create policies and practices that support junior staff to care for themselves, their families and their communities and use these policies.</p> <p><a href="https://journals.sagepub.com/doi/abs/10.1177/0891243216649946">Research</a> shows men want to be equal carers and sharers but often fear what taking time off for caregiving will signal to their employer despite evidence that fathers who request flexible work are perceived more <a href="https://academic.oup.com/sf/article-abstract/94/4/1567/2461609?login=false">favourably</a>.</p> <p>Appearing to be singularly devoted to work was shown to be impossible during the pandemic with kids, spouses, partners, and pets home all day long.</p> <p>Learning to create more care-inclusive workplaces and communities is critical.</p> <p>Paid parental leave, affordable and accessible high-quality childcare, flexibility in how, when and where we work and greater investments in paid sick leave, long-term disability support and aged care are just a few policies that would strengthen the care safety net.</p> <p>We will all be called upon to care at some point in our lives – let’s create the environments that support caregiving for all, not just mum.<!-- Below is The Conversation's page counter tag. How tracking menopause symptoms can give women more control over their health

And some of your symptoms and reactions might be due to the menopause, even if you are still having periods. Research shows that keeping track of those symptoms can help to alleviate them.</p> <p>People sometimes talk about the menopause as though it were a single event that happens when you are in your early 50s, which is <a href="https://www.mayoclinic.org/diseases-conditions/menopause/symptoms-causes/syc-20353397#:%7E:text=Menopause%20is%20the%20time%20that,is%20a%20natural%20biological%20process.">the average time</a> to have your last period. But the menopause generally stretches between the ages of 45 and 55. And some women will experience an earlier “medical” menopause because of surgery to remove the womb or ovaries.</p> <p>The menopause often happens at one of the busiest times of life. You might have teenagers at home or be supporting grown-up children, have elderly parents, be employed and have a great social life. If you feel exhausted, hot and bothered, irritable and can’t sleep well, you might be tempted to think that it is because you never get a minute’s peace. But that is why monitoring symptoms is important.</p> <p><a href="https://journals.lww.com/menopausejournal/Abstract/2023/03000/Symptom_monitoring_improves_physical_and_emotional.7.aspx">My team recently tested</a> the effects of tracking symptoms and emotions during the menopause. We asked women to rate 30 physical and 20 emotional symptoms of the menopause.</p> <p>The physical and psychological symptoms included poor concentration, problems with digesting food, stress and itchy skin, as well as the obvious symptoms like hot flushes and night sweats. Women tracked positive emotions like happiness and contentment, and negative emotions like feeling sad, isolated and angry.</p> <p>There were two groups of women in this study. One group recorded their symptoms and emotions every day for two weeks. The other group recorded their symptoms and emotions once at the beginning of the fortnight and once at the end.</p> <p>The results showed that the women who monitored their symptoms and emotions every day reported much lower negative emotions, physical symptoms and loneliness at the end of two weeks than at the beginning, compared to the other group.</p> <p>As well as this, although the loneliness scores of the group who monitored every day were lower than the other group, women in both groups said that being in the study and thinking about symptoms helped them feel less lonely. Simply knowing that other women were having similar experiences seemed to help.</p> <p>One participant said: “I feel more normal that other women are doing the same survey and are probably experiencing similar issues, especially the emotional and mental ones.”</p> <h2>Why does monitoring symptoms help?</h2> <p>One reason why tracking might help is that rating symptoms can help you notice changes and patterns in how you feel. This could encourage you to seek help.</p> <p>Another reason is that noticing changes in symptoms might help you link the change to what you have been doing. For example, looking at whether symptoms spike after eating certain foods or are better after exercise. This could mean that you change your behaviour in ways that improve your symptoms.</p> <p>Many menopause symptoms are known as “non-specific” symptoms. This is because they can also be symptoms of mental health, thyroid or heart problems. It is important not to think your symptoms are “just” the menopause. You should always speak to your doctor if you are worried about your health.</p> <p>Another good thing about monitoring symptoms is that you can take information about how often you experience symptoms and how bad they are to your GP appointment. This can help the doctor decide what might be the problem.</p> <p>Websites such as <a href="https://healthandher.com">Health and Her</a> and <a href="https://www.balance-menopause.com">Balance</a> offer symptom monitoring tools that can help you track what is happening to your physical and emotional health. If you squat in a vacant property, does the law give you the house for free? Well, sort of

<p><em><a href="https://theconversation.com/profiles/cathy-sherry-466">Cathy Sherry</a>, <a href="https://theconversation.com/institutions/macquarie-university-1174">Macquarie University</a></em></p> <p>Nothing excites law students like the idea of a free house. Or alternatively, enrages them. It depends on their politics. As a result, academics condemned to teaching property law find it hard to resist the “<a href="https://classic.austlii.edu.au/au/journals/MelbULawRw/2011/28.html">doctrine of adverse possession</a>”. The fact that a person can change the locks on someone else’s house, wait 12 years, and claim it as their own, makes students light up in a way that the Strata Schemes Management Act never will.</p> <p>The idea of “squatters’ rights” has received a lot of media attention recently amid the grim reality of the Australian housing market. It fuels commentators such as Jordan van den Berg, who <a href="https://www.instagram.com/purplepingers/">critiques bad landlords</a> on social media. Casting back to his days as a law student, <a href="https://www.sbs.com.au/news/the-feed/article/jordan-was-fed-up-with-australias-empty-houses-his-proposal-has-led-to-death-threats/stx6rv6fl">he’s promoting</a> the doctrine of adverse possession as a way of making use of vacant properties.</p> <p>As interesting as the doctrine is, it has little relevance in modern Australia. While it is necessary to limit the time someone has to bring legal proceedings to recover land – typically 12 or 15 years, depending on which state you’re in – most people don’t need that long to notice someone else is living in their house. If a family member is occupying a home that someone else has inherited or a tenant refuses to vacate at the end of a lease, owners tend to bring actions to recover their land pronto.</p> <p>So where did this doctrine come from, and what has it meant in practice?</p> <h2>Free house fetching millions</h2> <p>In unusual circumstances, people can lose track of their own land.</p> <p>Just before the second world war, Henry Downie moved out of his house in the Sydney suburb of Ashbury. Downie died a decade later, but his will was never administered. At the time of his death, a Mrs Grimes rented the house and did so for a further 50 years. Downie’s next of kin did not realise they had inherited the house or that they were Grimes’s landlord.</p> <p>Grimes died in 1998 and Bill Gertos, a property developer, saw the house was vacant. He changed the locks, did some repairs, then leased the house and paid the rates for the next 17 years. He then made an application under <a href="https://classic.austlii.edu.au/au/legis/nsw/consol_act/rpa1900178/s45d.html">NSW property laws</a> to become the registered proprietor. At this point, Downie’s next of kin became aware they may have been entitled to the property and disputed Gertos’s claim.</p> <p>The <a href="https://www8.austlii.edu.au/cgi-bin/viewdoc/au/cases/nsw/NSWSC/2018/1629.html">court held</a> Gertos had been “in possession” of the property since the late 1990s. The next of kin had a legal right to eject him, but they had failed to do so within the statutory time limit of 12 years. Gertos had the best claim to the house. He <a href="https://www.domain.com.au/6-malleny-street-ashbury-nsw-2193-2015821514">promptly sold it</a> for A$1.4 million.</p> <p>Outrageous as this may seem, the law encourages caring for land. If you fail to take responsibility for your land, and someone else does, you can lose it.</p> <h2>An old English tradition</h2> <p>Gertos’s jackpot was unusual, and adverse possession has always been more relevant in a country like England.</p> <p>First, for much of English history, many people did not have documentary title (deeds) to their land. People were illiterate, parchment was expensive, and documents could disappear in a puff of smoke in a house fire. The law often had to rely on people’s physical possession of land as proof of ownership.</p> <p>Second, as a result of feudalism, vast swathes of England were owned by the aristocracy. They and their 20th-century successors in title, often local councils, had a habit of forgetting they owned five suburbs in London.</p> <p>In the post second world war housing crisis, thousands of families, and later young people and students, <a href="https://www.bbc.co.uk/sounds/play/b017cfv4">squatted in vacant houses</a> owned by public and private landlords who lacked the means or motivation to maintain them.</p> <h2>A sign of the times</h2> <p>In contrast, in Australia, for most of our settler history, governments of all political persuasions actively prevented the emergence of a landed class.</p> <p>But now, courtesy of tax policies that <a href="https://www.quarterlyessay.com.au/essay/2023/11/the-great-divide">encourage investment</a> in residential real estate, we have a landlord class of Baby Boomer and Gen X investors. That has caused housing market stress as younger people cannot make the natural transition from being renters to homeowners. They are outbid by older, wealthier buyers whose tax benefits from negative gearing increase with every dollar they borrow to buy an investment property.</p> <p>Money flowing into the market then means that landlords’ greatest benefit is capital gain rather than income, and thanks to John Howard, investors pay <a href="https://theconversation.com/stranger-than-fiction-who-labors-capital-gains-tax-changes-will-really-hurt-109657">no tax</a> on half of that gain.</p> <p>Finally, an almost exclusive reliance by government on the <a href="https://australiainstitute.org.au/post/for-more-affordable-housing-we-need-more-public-housing/">private sector</a> to provide new homes – which it will only do if it is making a profit – has left many people in deep housing stress.</p> <p>While squatters in Australia are likely to find themselves swiftly subject to court orders for ejection, van den Berg’s rallying cry indicates just how inequitable the housing market has become. Baby Boomers and Gen X should be on notice – young people want their housing back. <!-- Below is The Conversation's page counter tag. Centenarian blood tests give hints of the secrets to longevity

<p><em><a href="https://theconversation.com/profiles/karin-modig-1473484">Karin Modig</a>, <a href="https://theconversation.com/institutions/karolinska-institutet-1250">Karolinska Institutet</a></em></p> <p>Centenarians, once considered rare, have become commonplace. Indeed, they are the <a href="https://www.weforum.org/agenda/2021/02/living-to-one-hundred-life-expectancy/">fastest-growing demographic group</a> of the world’s population, with numbers roughly doubling every ten years since the 1970s.</p> <p>How long humans can live, and what determines a long and healthy life, have been of interest for as long as we know. Plato and Aristotle discussed and <a href="https://pubmed.ncbi.nlm.nih.gov/12092789/">wrote about the ageing process</a> over 2,300 years ago.</p> <p>The pursuit of understanding the secrets behind exceptional longevity isn’t easy, however. It involves <a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC7105197/">unravelling the complex interplay</a> of genetic predisposition and lifestyle factors and how they interact throughout a person’s life. Now our recent study, <a href="https://link.springer.com/article/10.1007/s11357-023-00936-w">published in GeroScience</a>, has unveiled some common biomarkers, including levels of cholesterol and glucose, in people who live past 90.</p> <p>Nonagenarians and centenarians have long been of intense interest to scientists as they may help us understand how to live longer, and perhaps also how to age in better health. So far, studies of centenarians have often been small scale and focused on a selected group, for example, excluding centenarians who live in care homes.</p> <h2>Huge dataset</h2> <p>Ours is the largest study comparing biomarker profiles measured throughout life among exceptionally long-lived people and their shorter-lived peers to date.</p> <p>We compared the biomarker profiles of people who went on to live past the age of 100, and their shorter-lived peers, and investigated the link between the profiles and the chance of becoming a centenarian.</p> <p>Our research included data from 44,000 Swedes who underwent health assessments at ages 64-99 - they were a sample of <a href="https://pubmed.ncbi.nlm.nih.gov/28158674/">the so-called Amoris cohort</a>. These participants were then followed through Swedish register data for up to 35 years. Of these people, 1,224, or 2.7%, lived to be 100 years old. The vast majority (85%) of the centenarians were female.</p> <p>Twelve blood-based biomarkers related to inflammation, metabolism, liver and kidney function, as well as potential malnutrition and anaemia, were included. All of these <a href="https://www.nature.com/articles/s41591-019-0719-5">have been associated</a> with ageing or mortality in previous studies.</p> <p>The biomarker related to inflammation was uric acid – a waste product in the body caused by the digestion of certain foods. We also looked at markers linked to metabolic status and function including total cholesterol and glucose, and ones related to liver function, such as alanine aminotransferase (Alat), aspartate aminotransferase (Asat), albumin, gamma-glutamyl transferase (GGT), alkaline phosphatase (Alp) and lactate dehydrogenase (LD).</p> <p>We also looked at creatinine, which is linked to kidney function, and iron and total iron-binding capacity (TIBC), which is linked to anaemia. Finally, we also investigated albumin, a biomarker associated with nutrition.</p> <h2>Findings</h2> <p>We found that, on the whole, those who made it to their hundredth birthday tended to have lower levels of glucose, creatinine and uric acid from their sixties onwards. Although the median values didn’t differ significantly between centenarians and non-centenarians for most biomarkers, centenarians seldom displayed extremely high or low values.</p> <p>For example, very few of the centenarians had a glucose level above 6.5 earlier in life, or a creatinine level above 125.</p> <p>For many of the biomarkers, both centenarians and non-centenarians had values outside of the range considered normal in clinical guidelines. This is probably because these guidelines are set based on a younger and healthier population.</p> <p>When exploring which biomarkers were linked to the likelihood of reaching 100, we found that all but two (alat and albumin) of the 12 biomarkers showed a connection to the likelihood of turning 100. This was even after accounting for age, sex and disease burden.</p> <p>The people in the lowest out of five groups for levels of total cholesterol and iron had a lower chance of reaching 100 years as compared to those with higher levels. Meanwhile, people with higher levels of glucose, creatinine, uric acid and markers for liver function also decreased the chance of becoming a centenarian.</p> <p>In absolute terms, the differences were rather small for some of the biomarkers, while for others the differences were somewhat more substantial.</p> <p>For uric acid, for instance, the absolute difference was 2.5 percentage points. This means that people in the group with the lowest uric acid had a 4% chance of turning 100 while in the group with the highest uric acid levels only 1.5% made it to age 100.</p> <p>Even if the differences we discovered were overall rather small, they suggest a potential link between metabolic health, nutrition and exceptional longevity.</p> <p>The study, however, does not allow any conclusions about which lifestyle factors or genes are responsible for the biomarker values. However, it is reasonable to think that factors such as nutrition and alcohol intake play a role. Keeping track of your kidney and liver values, as well as glucose and uric acid as you get older, is probably not a bad idea.</p> <p>That said, chance probably plays a role at some point in reaching an exceptional age. But the fact that differences in biomarkers could be observed a long time before death suggests that genes and lifestyle may also play a role.<!-- Below is The Conversation's page counter tag. Gal Gadot gives birth to fourth child after secret pregnancy

“Meant to be”: Twins give birth just 22 minutes apart

<p dir="ltr">Just days after sharing their 33rd birthday, twin sisters Nicole and Renee Baillie have given birth on the same day. </p> <p dir="ltr">The women, from Queensland’s Sunshine Coast, were shocked when they fell pregnant around the same time, with their due dates just two weeks apart. </p> <p dir="ltr">“We magically fell pregnant at the same time, which was crazy,” Nicole told <em><a href="https://7news.com.au/news/sunshine-coast-twins-give-birth-just-22-minutes-apart--c-13517897">7News</a></em>. </p> <p dir="ltr">Nicole was already at the hospital ready to give birth to her baby when Renee went into labour early. </p> <p dir="ltr">Renee rushed to the hospital just in time to give birth in the hospital foyer,  welcoming a baby girl named Ruby.</p> <p dir="ltr">“I was just about to have a bath when I heard someone had a baby in the corridor,” Nicole said.</p> <p dir="ltr">“I couldn’t believe it,” Renee said.</p> <p dir="ltr">“When I got here, into this room after we had (the baby), I wasn’t sure how far along Nicole was. I didn’t want her (Nicole) to know I’d already had my baby, just in case it, like, threw her off.”</p> <p dir="ltr">Renee soon found out Nicole had given birth to a baby boy, named Zavian, only 22 minutes earlier.</p> <p dir="ltr">“I thought I had a few days left, but they decided they wanted to be born on the same day,” Renee said.</p> <p dir="ltr">“It was just meant to be, and I think everyone has just manifested this happening,” Nicole said.</p> <p dir="ltr"><em>Image credits: 7News</em></p>

"What gives?" Victorian MP slams "photoshopped" image

<p>A Victorian MP has slammed Channel Nine for airing a "photoshopped" image of her, in which her outfit was made more "revealing" and her breasts were "enlarged". </p> <p>Georgie Purcell, an MP for the Animal Justice Party, was featured on Nine News on Monday night during a segment about duck hunting, with the network using a promotional image of the MP for the TV package. </p> <p>However, Ms Purcell claims the major news work altered the photo, and took to social media to share a side by side comparison of the original image and the one Nine aired. </p> <p>“I endured a lot yesterday. What gives?”</p> <p>In a second tweet, Purcell pointed out her stomach has been tattooed since 2020 and the photoshopped image did not show any tattoos, despite her outfit being changed to show her stomach.</p> <p>On Tuesday, a statement was issued from Nine News Melbourne news director Hugh Nailon apologising for the “graphic error”.</p> <p>“Our graphics department sourced an online image of Georgie to use in our story on duck hunting,” he said.</p> <p>“As is common practice, the image was resized to fit our specs. During that process, the automation by Photoshop created an image that was not consistent with the original.</p> <p>“This did not meet the high editorial standards we have and for that we apologise to Ms Purcell unreservedly.”</p> <p>Purcell told 7News that she only realised her image had been photoshopped when she watched Nine’s bulletin.</p> <p>“I noticed because my stomach didn’t have a tattoo on it. Is your diet giving you headaches?

<p><strong>Diet-induced headaches</strong></p> <p>If you’re searching for the cause of that niggling headache, it’s possible that what you’re eating – or drinking – could be to blame.</p> <p><strong>Stop over-restricting your kilojoule intake</strong></p> <p>Spacing your meals too far apart or eating at irregular intervals causes a dip in blood-glucose levels, which drives your body into starvation mode. This triggers a cascade of hormones and brain chemicals similar to your body’s response to stress, which can bring on headaches. Once you fuel up, the headache should go away.</p> <p><span style="text-decoration: underline;"><em>Tip:</em></span> You should wait no more than four hours between meals. Try light snacks between meals, such as a handful of almonds.</p> <p><strong>Stay hydrated </strong></p> <p>Dehydration is a common headache trigger. Experts suspect it may have to do with narrowing of blood vessels in the brain, which reduces the brain’s supply of blood and oxygen. Not getting sufficient electrolytes may also contribute to headaches.</p> <p><span style="text-decoration: underline;"><em>Tip:</em></span> By the time you feel thirsty, your body is already a little dehydrated, so rehydrate often. Have a glass of water with every meal and between meals.</p> <p><strong>Avoid artificial sweeteners</strong></p> <p>Some people may be particularly sensitive to aspartame, which can lead to headaches, according to a US study. Aspartame can be in diet drinks as well as foods.</p> <p><span style="text-decoration: underline;"><em>Tip:</em></span> If you suspect artificial sweeteners may be triggering your headaches, keep a food journal to watch for patterns.</p> <p><strong>Cut caffeine slowly</strong></p> <p>If you’ve ditched fizzy drinks or coffee, you may be experiencing caffeine withdrawal. Hughesy gives health update after being rushed to hospital

<p>Dave 'Hughesy' Hughes has shared an update on a dramatic accident he suffered on New Year's Eve, after he was rushed to hospital in the "worst pain of my life". </p> <p>The TV and radio host took to Instagram to admit he had the "least sober NYE in 30+ years", after having to take extensive pain killers to cope with a severe injury. </p> <p>Hughesy shared that he suffered a "shoulder dislocation whilst surfing" while spending time on the Gold Coast over the holiday season, which saw him rushed to hospital for the injury. </p> <p>He shared that he had "morphine and the rest of them" after enduring "two hours of the worst pain of my life", as he shared a series of photos of the dramatic incident.</p> <blockquote class="instagram-media" style="background: #FFF; Obese woman sparks debate for not giving up extra seat for toddler

<p>An obese woman has sparked debate online after refusing to give up the second seat she paid for to a fussy toddler. </p> <p>The 34-year-old booked the two seats for her cross-country flight to visit her family for Christmas because she was previously unable to comfortably fit in one seat. </p> <p>All was well until the young woman next to her demanded that she "squeeze into one seat" so her son could sit on the other. </p> <p>"I am obese," she admitted on the Reddit thread. "I'm actively working toward losing weight and I've made progress - but I booked an extra seat because I'm fat."</p> <p>She added that she insisted on keeping her seat because she paid for it, but the mum "made a big fuss over it, and she told the flight attendant I was stealing the seat from her son." </p> <p>"Then I showed her my boarding passes, proving that I paid for the extra seat. The flight attendant asked me if I could try to squeeze in, but I said no, that I wanted the extra seat I paid for."</p> <p>The woman claimed that the toddler was only 18 months old, so he didn't need his own seat and could've sat on his mum's lap for the duration of the flight. </p> <p>"I got dirty looks and passive-aggressive remarks from her for the entire flight and I do feel a little bad because the boy looked hard to control - but am I in the wrong?" she asked other social media users. </p> <p>Many shared their overwhelming support for the woman and slammed the mum and flight attendant for their "horrific" behaviour. </p> <p>"The mum is an a**hole for not buying a seat for her son and assuming someone else would give up a seat they paid for. Odds are she was hoping there'd be extra seats on the flight so she didn't have to pay and used the lap thing as a loophole," one commented. </p> <p>"What's even the point of the extra seat if the flight attendants are going to let entitled people bully others into giving it up?" another added. </p> <p>"People buy entire seats for high-end musical equipment. Not even people. Their lack of planning does not constitute an emergency on your part," a third wrote. </p> <p>However, there were a few others that said the woman was in the wrong for causing an inconvenience. </p> <p>"If you are so fat that you have to have more than one seat on an airplane then you are selfish," one said. </p> <p>"Flights overbook all the time especially during the holidays - how can you justify having two seats to yourself?" </p> <p>"How much room does a kid take up, seriously? Gift-giving taboos that aren’t as bad as you think

<p><em><a href="https://theconversation.com/profiles/mary-steffel-213379">Mary Steffel</a>, <a href="https://theconversation.com/institutions/northeastern-university-1644">Northeastern University</a> and <a href="https://theconversation.com/profiles/elanor-williams-213382">Elanor Williams</a>, <a href="https://theconversation.com/institutions/indiana-university-1368">Indiana University</a></em></p> <p>There are many social norms that dictate gift-giving, including when, how and what to give as gifts.</p> <p>Interestingly, these norms don’t seem to be about making sure that recipients get the gifts they want. What makes for a good or bad gift often differs in the eyes of givers and recipients.</p> <p>In fact, behavioral science research shows that gifts that may seem “taboo” to givers might actually be better appreciated by recipients than they might think.</p> <h2>Taboo #1: giving money</h2> <p>Givers often worry that giving cash or gift cards might be seen as impersonal, thoughtless or crass. Yet <a href="http://static1.squarespace.com/static/5399fab2e4b083bff5af4518/t/5499c4fee4b0bb5843a0b371/1419363582068/Giver-Recipient+Discrepancies+in+Gift+Giving+Draft+12-17-14+FINAL.pdf">research</a> we have done with Robyn LeBoeuf of Washington University in St Louis shows that recipients prefer these more versatile gifts more than givers think they do.</p> <p>We find that givers underestimate how much recipients like seemingly impersonal monetary gifts, mistakenly thinking that they’ll prefer a traditional gift to a gift card, for instance, or a gift card to cash, when the opposite is true. And, contrary to givers’ expectations, recipients think that these less personal gifts are more thoughtful, too.</p> <p>Why don’t givers realize this? We find that givers tend to focus on recipients’ enduring traits and tastes and choose gifts that are tailored to those characteristics, and recipients are more likely to focus on their varying wants and needs and prefer gifts that give them the freedom to get whatever they currently need or desire most.</p> <p>Prompting givers to shift their focus from what recipients <em>are</em> like to what they <em>would</em> like makes them more likely to choose the versatile gifts that recipients prefer.</p> <h2>Taboo #2: giving a practical gift</h2> <p>A classic sitcom plotline involves the <a href="http://tvtropes.org/pmwiki/pmwiki.php/Main/GiftGivingGaffe">gift-giving gaffe</a>, with a prime example being the husband who buys his wife a vacuum cleaner or something else practical when the occasion seems to call for something more sentimental.</p> <p>These blundering husbands might not be as wrong as you’d think, though: research suggests that practical gifts are actually better-liked by recipients than givers expect. For instance, <a href="https://msbfile03.usc.edu/digitalmeasures/wakslak/intellcont/baskin%20wakslak%20trope%20novemsky%20(2014)-1.pdf">research</a> by Ernest Baskin of Saint Joseph’s University and colleagues demonstrates that givers tend to focus on how desirable a gift is, when recipients might prefer they think a little more about how easy that gift is to use.</p> <p>A gift certificate to the best restaurant in the state might not be so great a gift if it takes three hours to get there; your recipient might think that a gift certificate to a less noteworthy but closer restaurant is actually a better gift.</p> <p>In fact, even gifts that aren’t much fun at all, like the fabled vacuum cleaner, can make for great gifts in recipients’ eyes. <a href="https://static1.squarespace.com/static/50a5e160e4b0e80bad9bfe3d/t/567755bbc21b8664a205e822/1450661307640/SJDM+2015+Submission_ER_EFW.pdf">Work</a> that Williams has done with Emily Rosenzweig of Tulane University shows that recipients have a stronger preference for useful rather than fun gifts than givers expect them to have.</p> <p>We find that the best gifts people have received are much more useful than the best gifts they think they have given, and they want givers to put less emphasis on the fun features of a gift and more emphasis on its useful features than they themselves would when picking out a gift to give to someone else.</p> <h2>Taboo #3: giving an ‘uncreative’ gift</h2> <p>Givers often feel pressure to think of creative gifts that demonstrate how much thought they put into the gift and how well they know the recipient.</p> <p>This means that, even when they are given explicit instructions on what to purchase, givers frequently ignore recipients’ wish lists or gift registries and instead try to come up with ideas for gifts by themselves. Givers think that their unsolicited gift ideas will be appreciated just as much as the ideas on wish lists and registries, but <a href="http://static1.squarespace.com/static/55dcde36e4b0df55a96ab220/t/55e746dee4b07156fbd7f6bd/1441220318875/Gino+Flynn+JESP+2011.pdf">recipients would rather</a> have the gifts they requested.</p> <p>Another implication of this is that givers often pass up gifts they know would be better-liked in favor of getting different gifts for each person they give a gift to, according to <a href="http://static1.squarespace.com/static/5399fab2e4b083bff5af4518/t/539a15b3e4b0bf580fb57539/1402607027977/SteffelLeBoeuf2014.pdf">research</a> by Steffel and LeBoeuf. Givers feel like they are being more thoughtful by getting something unique and creative for each person on their shopping list, but recipients would rather have what’s on the top of their wish list, especially if they are unlikely to compare gifts.</p> <p>We find that encouraging givers to consider what recipients would choose for themselves before choosing a gift makes them more likely to go ahead and get the same better-liked gift for more than one recipient.</p> <h2>Taboo #4: giving a gift that can’t be unwrapped</h2> <p>The very idea of exchanging gifts suggests to people that they need to give something that can be tied up with a pretty bow and then unwrapped, but, in fact, some of the best gifts aren’t things at all.</p> <p>A <a href="http://static1.squarespace.com/static/5394dfa6e4b0d7fc44700a04/t/547d589ee4b04b0980670fee/1417500830665/Gilovich+Kumar+Jampol+%28in+press%29+A+Wonderful+Life+JCP.pdf">wealth of research</a> has shown that money is often better spent on experiences than on material goods, and this seems to be true for gifts as well as personal purchases.</p> <p>Joseph Goodman of Washington University in St Louis and Sarah Lim of Seoul National University <a href="http://apps.olin.wustl.edu/faculty/goodman/Giving%20Happiness.pdf">have found</a> that givers think that material items that can be physically exchanged and unwrapped make for better gifts, when gifts that are experiences actually make recipients happier.</p> <p>Experiential gifts have benefits beyond simply boosting their recipients’ enjoyment, as well. Cindy Chan of the University of Toronto and Cassie Mogilner of the University of Pennsylvania <a href="https://www.rotman.utoronto.ca/-/media/Files/Programs-and-Areas/Marketing/papers/ChanMogilner2013.pdf">have shown</a> that receiving an experiential gift prompts stronger emotional reactions in recipients, and this makes them feel closer to the person who gave them the gift. In other words, opt for the swing dance lessons over the sweater – it will make the recipient happier, and bring the two of you closer together, to boot.</p> <h2>If you still can’t think of a gift…</h2> <p>Gift-giving, especially around the holidays, can be a stressful process for both giver and recipient. An understanding of which gift-giving norms are misguided can perhaps relieve some of this stress and lead to better gifts and happier recipients (and givers, too).</p> <p>But even if givers ignore this advice, there is hope: one last taboo to bust is the taboo on regifting. According Gabrielle Adams of the London Business School and colleagues, givers <a href="http://www.people.hbs.edu/mnorton/adams%20flynn%20norton.pdf">aren’t as bothered</a> by regifting as recipients think.</p> <p>Even if what you get is not what you want, you can pass it along to someone else, and hope that next time, the norms will work in your favor.<!-- Below is The Conversation's page counter tag. The 4 biggest gift-giving mistakes, according to a consumer psychologist

<p><em><a href="https://theconversation.com/profiles/julian-givi-1395671">Julian Givi</a>, <a href="https://theconversation.com/institutions/west-virginia-university-1375">West Virginia University</a></em></p> <p>A good gift can elicit a surge of happiness and gratitude in the recipient. It also feels great to give, <a href="https://theconversation.com/whats-the-point-of-holiday-gifts-173306">with psychologists finding</a> that the joy of giving a gift is more pronounced than the pleasure of receiving one.</p> <p>Unfortunately, there are times when you receive a gift and you have to force a smile and fake your gratitude.</p> <p>I’m a consumer psychologist <a href="https://scholar.google.com/citations?user=wjAq_TcAAAAJ&amp;hl=en">who specializes in gift-giving research</a> – in particular, gift-giving mistakes.</p> <p>Here are four of the most common ones.</p> <h2>1. Prioritizing the big reveal</h2> <p>One way givers can err is by focusing too much on <a href="https://doi.org/10.1177/0963721416656937">the moment the recipient will open the gift</a>.</p> <p>Givers want their gift to be <a href="https://doi.org/10.1086/675737">desirable</a>. They hope <a href="https://doi.org/10.1016/j.jesp.2011.03.015">to surprise</a> the recipient and <a href="http://dx.doi.org/10.2139/ssrn.2733341">put a smile</a> on their face.</p> <p>A chocolate fondue fountain might meet these criteria – it’s quirky and sure to elicit curiosity and smiles from onlookers.</p> <p>However, when people receive a gift, they care less about the moment the bow comes off, and instead think about the weeks and months ahead.</p> <p>People want gifts that are <a href="https://www.acrwebsite.org/volumes/1023703/volumes/v45/NA-45">useful</a> and <a href="https://doi.org/10.1086/675737">reliable</a> and <a href="https://doi.org/10.1016/j.jesp.2011.03.015">meet their needs</a>.</p> <p>How often would a chocolate fondue fountain realistically be used?</p> <p>Compare that to a new coffee maker, which could see action every day. Sure, it isn’t a novelty – and probably won’t elicit “oohs” and “ahhs” on Christmas Day – but the recipient will be quite happy to have it on hand when their alarm rings each morning.</p> <h2>2. Unique and new are overrated</h2> <p>Another factor that can lead givers to go wrong involves unwritten rules for what constitutes good gift-giving practices.</p> <p>Givers often focus on these rules more than they should. For example, they may <a href="https://doi.org/10.1016/j.jbusres.2020.05.023">avoid giving the same gift</a> to someone in back-to-back years because this goes against the norm of giving a unique gift each year. Givers also often <a href="https://doi.org/10.1348/014466604x23428">refrain from giving used products</a> as gifts because this violates the unspoken rule that a gift should be brand new.</p> <p>In contrast, recipients are quite open to gifts that violate these norms.</p> <p>If someone loves a certain type of wine, they’re <a href="https://doi.org/10.1016/j.jbusres.2020.05.023">more than happy to receive it</a> in subsequent years. And if one digital camera is lightly used but possesses several innovative features, while another is new but has fewer features, people <a href="https://doi.org/10.1348/014466604x23428">are happy to receive the used one</a>.</p> <h2>3. Being risk-averse</h2> <p>Givers can make missteps when they avoid gifts that they see as too risky.</p> <p>Consider sentimental gifts, like a scrapbook or a nostalgic memento.</p> <p>Studies have shown that recipients <a href="https://doi.org/10.1016/j.jcps.2017.06.002">love these gifts</a>; they <a href="https://doi.org/10.1037/pspa0000036">elicit happiness for extended periods of time</a>.</p> <p>Givers, however, tend to <a href="https://doi.org/10.1016/j.jcps.2017.06.002">shy away from sentimental gifts</a> because they see them risky – sure, they could be a home run, but they could also whiff. Doubts can creep into shoppers’ heads as they consider sentimental gifts: What if it comes across as sappy? What if the recipient thinks I’m being cheap?</p> <p>And so people tend to opt for <a href="https://www.sciencedirect.com/science/article/abs/pii/S105774081730044X">safer, superficial gifts</a> that they assume will be at least somewhat well-liked. Or, to continue with the baseball analogy, givers are happy to take the sure single.</p> <p>As another example, consider material goods versus experiences.</p> <p>When giving gifts, people often opt for <a href="https://doi.org/10.1093/jcr/ucy010">tangible objects over experiences</a> because material goods are on the safer side – almost everyone could use a new appliance or a new shirt. Experiences are trickier; they require a bit more of an understanding of who the recipient truly is – not everyone loves going to see the symphony.</p> <p>Yet recipients tend to be <a href="https://doi.org/10.1002/jcpy.1281">more open to experiences than givers anticipate</a> – and these gifts <a href="https://www.acrwebsite.org/volumes/1017575/volumes/v42/NA-42">are actually more likely to make people happier</a> than material goods.</p> <h2>4. Does the thought really count?</h2> <p>Givers can also err by wanting their gift to appear especially thoughtful.</p> <p>Of course, recipients appreciate thoughtfulness – but not when it comes at the expense of receiving something that’s actually useful.</p> <p>This plays out when givers are shopping for multiple people. They’ll often <a href="https://doi.org/10.1086/674199">choose unique gifts for each recipient</a>, rather than give the same gift to everyone, because a distinct gift for each person will make them feel as though they put more time and effort into gift selection. People do this even if they realize that some recipients will be receiving less desirable gifts.</p> <p>You’ll also see this happen with <a href="https://www.acrwebsite.org/volumes/1020146/volumes/v43/NA-43">gift cards</a>. Givers often choose specific gift cards – to a particular clothing store or restaurant, for example – that reflect the interests or tastes of the recipient.</p> <p>But recipients are more open to gift cards that give them more flexibility and freedom – think an Amazon or Visa gift card. How risky is it to give card details over the phone and how do I reduce the chance of fraud?

While doing so is second nature, we may be more reluctant to provide card details over the phone.</p> <p>Merchants are allowed to ask us for credit card details over the phone – this is perfectly legal. But there are minimum standards they must comply with and safeguards to protect consumer data.</p> <p>So is giving your card details over the phone any more risky than other transactions and how can you minimise the risks?</p> <h2>How is my card data protected?</h2> <p>For a merchant to process card transactions, they are expected to comply with the <a href="https://docs-prv.pcisecuritystandards.org/PCI%20DSS/Standard/PCI-DSS-v4_0.pdf">Payment Card Industry Data Security Standard</a>. This is a set of security requirements designed to protect cardholder data and the trillions of dollars of transactions each year.</p> <p>Compliance involves various security measures (such as encryption and access controls) together with strong governance and regular security assessments.</p> <p>If the information stored by the merchant is accessed by an unauthorised party, encryption ensures it is not readable. That means stealing the data would not let the criminals use the card details. Meanwhile, access controls ensure only authorised individuals have access to cardholder data.</p> <p>Though all companies processing cards are expected to meet the compliance standards, only those processing large volumes are subject to mandatory regular audits. Should a subsequent data leak or misuse occur that can be attributed to a compliance failure, a <a href="https://www.csoonline.com/article/569591/pci-dss-explained-requirements-fines-and-steps-to-compliance.html">company can be penalised</a> at levels that can escalate into millions of dollars.</p> <p>These requirements apply to all card transactions, whether in person, online or over the phone. Phone transactions are likely to involve a human collecting the card details and either entering them into computer systems, or processing the payment through paper forms. The payment card Security Standards Council has <a href="https://docs-prv.pcisecuritystandards.org/Guidance%20Document/Telephone-Based%20Payments/Protecting_Telephone_Based_Payment_Card_Data_v3-0_nov_2018.pdf">detailed guides for best practice</a>:</p> <blockquote> <p>A policy should be in place to ensure that payment card data is protected against unauthorised viewing, copying, or scanning, in particular on desks.</p> </blockquote> <p>Although these measures can help to protect your card data, there are still risks in case the details are misplaced or the person on the phone aren’t who they say they are.</p> <h2>Basic tips for safe credit card use over the phone</h2> <p>If you provide card details over the phone, there are steps you can take to minimise the chance you’ll become the victim of fraud, or get your details leaked.</p> <p><strong>1. Verify the caller</strong></p> <p>If you didn’t initiate the call, hang up and call the company directly using details you’ve verified yourself. Scammers will often masquerade as a well-known company (for example, an online retailer or a courier) and convince you a payment failed or payment is needed to release a delivery.</p> <p>Before you provide any information, confirm the caller is legitimate and the purpose of the call is genuine.</p> <p><strong>2. Be sceptical</strong></p> <p>If you are being offered a deal that’s too good to be true, have concerns about the person you’re dealing with, or just feel something is not quite right, hang up. You can always call them back later if the caller turns out to be legitimate.</p> <p><strong>3. Use secure payment methods</strong></p> <p>If you’ve previously paid the company with other (more secure) methods, ask to use that same method.</p> <p><strong>4. Keep records</strong></p> <p>Make sure you record details of the company, the representative you are speaking to and the amount being charged. You should also ask for an order or transaction reference. Don’t forget to ask for the receipt to be sent to you.</p> <p>Check the transaction against your card matches the receipt – use your banking app, don’t wait for the statement to come through.</p> <h2>Virtual credit cards</h2> <p>In addition to the safeguards mentioned above, a <a href="https://www.forbes.com/advisor/credit-cards/virtual-credit-card-numbers-guide/">virtual credit card</a> can help reduce the risk of card fraud.</p> <p>You probably already have a form of virtual card if you’ve added a credit card to your phone for mobile payments. Depending on the financial institution, you can create a new credit card number linked to your physical card.</p> <p>Some banks extend this functionality to allow you to generate unique card numbers and/or CVV numbers (the three digits at the back of your card). With this approach you can easily separate transactions and cancel a virtual card/number if you have any concerns.</p> <h2>What to do if you think your card details have been compromised or stolen?</h2> <p>It’s important not to panic, but quick action is essential:</p> <ul> <li> <p>call your bank and get the card blocked so you won’t lose any more money. Depending on your situation, you can also block/cancel the card through your banking app or website</p> </li> <li> <p>report the issue to the police or other relevant body</p> </li> <li> <p>monitor your account(s) for any unusual transactions</p> </li> <li> <p>explore card settings in your banking app or website – many providers allow you to limit transactions based on value, restrict transaction types or enable alerts</p> </li> <li> <p>you may want to consider registering for <a href="https://theconversation.com/your-credit-report-is-a-key-part-of-your-privacy-heres-how-to-find-and-check-it-116999">credit monitoring services</a> and to enable fraud alerts.</p> </li> </ul> <h2>So, should I give my card details over the phone?</h2> <p>If you want to minimise risk, it’s best to avoid giving card details over the phone if you can. Sir Billy Connolly gives sad health update

<p>Sir Billy Connolly, the legendary Scottish comedian, has shared a sombre update on his ongoing battle with Parkinson's disease. In an interview with his wife, author Pamela Stephenson, for <a href="https://www.theguardian.com/culture/2023/sep/30/billy-connolly-interview-pamela-stephenson-connolly" target="_blank" rel="noopener"><em>The Guardian</em></a>, Connolly revealed that he has experienced a significant setback in his health.</p> <p>The 80-year-old comedian disclosed that he is now grappling with a new symptom of the degenerative disorder: balance issues. He mentioned that he has recently endured "a couple of serious falls" due to a noticeable decline in his balance. Connolly expressed his surprise at this development, explaining, "That was never such a problem before, but in the last year, that has come, and it has stayed."</p> <p><span style="font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen, Ubuntu, Cantarell, 'Open Sans', 'Helvetica Neue', sans-serif;">Connolly was diagnosed with Parkinson's in 2013, a diagnosis that came on the same day he learned he had prostate cancer. Fortunately, he has received a clean bill of health regarding the prostate cancer after undergoing surgery in the same year. However, these health challenges forced him to retire from live performances in 2018.</span></p> <p>Stephenson, who also serves as Connolly's caregiver, pointed out that the loss of balance has been the most significant issue they have faced since his Parkinson's diagnosis, leading to "a couple of serious falls."</p> <p>In a moment of levity during the interview, Connolly reflected on one of his falls, saying, "It's funny, that fall I had when I landed on my jaw reminded me of a thing I used to do on stage. I used to say: 'I fell out of bed, but luckily my face broke my fall.'"</p> <p>The Scottish icon added that this new symptom has further limited his ability to enjoy activities like long walks: "I feel like I want to go for a walk, but I go for 50 yards and I want to go home because I'm tired. I'm being encroached upon by this disease. It's creeping up behind me and stopping me from doing things. It's a cruel disease."</p> <p>Connolly and Stephenson also discussed how their relationship has evolved since his diagnosis. As his caregiver, Stephenson assists him with daily tasks such as getting dressed, and provides transportation since he can no longer drive. No, the Voice to Parliament would not force people to give up their private land

<p><em><a href="https://theconversation.com/profiles/kate-galloway-9907">Kate Galloway</a>, <a href="https://theconversation.com/institutions/griffith-university-828">Griffith University</a></em></p> <p>In the polarised debate about the Voice to Parliament referendum, some proponents of the “no” vote have <a href="https://www.aap.com.au/factcheck/voice-legislation-does-not-authorise-a-land-grab/">claimed</a> the creation of the new advisory body would lead to the conversion of private land titles in Australia to native title.</p> <p>The implication is that people will be forced to give up their land. This has sown fear among some Australians.</p> <p>Last week, a false letter purporting to be from a member of the First Peoples’ Assembly of Victoria was distributed to homes in regional Victoria, saying the body was moving into the “next phase of reacquiring land”. The minister for Indigenous Australians, Linda Burney, <a href="https://www.theage.com.au/national/victoria/fake-letter-scaremongering-about-indigenous-land-claims-sparks-outrage-20230912-p5e43n.html">called</a> it a “another example of the dirty tricks campaign” being waged to sow doubt over the Voice referendum.</p> <p>Similar concerns were raised following the High Court decision in the <a href="https://aiatsis.gov.au/explore/mabo-case">Mabo case</a> in 1992 and passage of the <a href="https://www.legislation.gov.au/Details/C2017C00178">Native Title Act</a> a year later.</p> <p>Like the fear-mongering over the Mabo decision, the current alarm over the potential loss of private lands with a Voice to Parliament is unwarranted because this claim is manifestly incorrect.</p> <p>There are two foundational legal reasons why:</p> <ul> <li> <p>because of the words of the proposed constitutional amendment itself</p> </li> <li> <p>and because of the way that native title works.</p> </li> </ul> <h2>Would the proposed Voice have powers related to land?</h2> <p>The proposed constitutional amendment that would create the Voice is very simple. It seeks to insert one new section into the Constitution, which reads:</p> <blockquote> <p>In recognition of Aboriginal and Torres Strait Islander peoples as the First Peoples of Australia:</p> <ol> <li> <p>there shall be a body, to be called the Aboriginal and Torres Strait Islander Voice;</p> </li> <li> <p>the Aboriginal and Torres Strait Islander Voice may make representations to the Parliament and the Executive Government of the Commonwealth on matters relating to Aboriginal and Torres Strait Islander peoples;</p> </li> <li> <p>the Parliament shall, subject to this Constitution, have power to make laws with respect to matters relating to the Aboriginal and Torres Strait Islander Voice, including its composition, functions, powers and procedures.</p> </li> </ol> </blockquote> <p>The words clearly provide for only one activity to be undertaken by the Voice. The new body “may make representations” on matters relating to Aboriginal and Torres Strait Islander people.</p> <p>There is no express or hidden power to either take people’s land or give land to First Nations people. The Voice is a committee that may provide advice to parliament and government on issues relating to First Nations people. That is all.</p> <p>And this advice is not binding. The parliament of the day is free to ignore it, if it wishes to.</p> <p>The new provision also gives one sole power to the parliament – it would have the capacity to set up the Voice. It is not possible to understand this provision as creating a special power to take people’s land, or to “convert” land to native title.</p> <p>Importantly, the power to establish the Voice would not be given to the government – it would belong to parliament. In exercising this power, normal parliamentary processes will apply and the parliament will be accountable to the public.</p> <p>There are no other changes to the Constitution proposed in this referendum.</p> <h2>How native title works</h2> <p>In the famous Mabo case, the High Court found that the land title of Aboriginal and Torres Strait Islander people, held under their traditional law and custom, survived the introduction of British sovereignty over Australia.</p> <p>Mabo confirmed native title can only be claimed over land where there is no interest in conflict with the exercise of this right. Native title will always give way to grants of exclusive land use.</p> <p>Following this decision, the law now states that every grant of freehold land (“private” land) extinguishes native title. Further, in the later case of <a href="https://jade.io/article/68082">Fejo v Northern Territory</a>, the High Court confirmed that once native title has been extinguished, it cannot be revived.</p> <p>Consequently, even if the constitutional change creating the Voice did (somehow) recognise native title, it is not possible to “convert” freehold land to native title. On private land, native title no longer exists under Australian law.</p> <p>To put these claims of “land conversion” in context, it is helpful to recall the public response to the Mabo decision.</p> <p>Following the High Court judgement in Mabo, the mining industry ran a national campaign asserting that native title would threaten people’s back yards. The managing director of Western Mining, Hugh Morgan, <a href="https://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;query=(Id:library/prspub/raf10);rec=0">said</a> the High Court’s decision</p> <p>"put at risk the whole legal framework of property rights throughout the whole community."</p> <p>This campaign led to significant public fear about the effects of native title.</p> <p>These claims about native title after Mabo were incorrect. Private landholdings have not been threatened. Indeed, on the ten-year anniversary of the Mabo decision, former Victorian Premier Jeff Kennett even <a href="https://www.theage.com.au/national/i-was-wrong-on-mabo-kennett-20020601-gdu9dt.html">admitted that his initial fears had been unfounded</a>.</p> <p>In reading or listening to claims about the effect of the Voice, it is prudent to question the source of information. If you have questions, seek a reliable source to read the words of the proposed amendment and understand the objective of the constitutional change. If you hear of a claim that seems extreme, it may well be aimed at diverting the public’s attention from the real issues.<!-- Below is The Conversation's page counter tag.
